مفهوم دولت کمالگرا برخلاف حقوق بشر، با اولویت دادن به مفاهیمی چون فضیلت و امر خوب به جای مفاهیم حق و امر درست، براساس مکتب اخلاقی فضیلتگرا حکمرانی میکند. در این پایاننامه بدین مساله پرداخته خواهد شد که دولت کمالگرا و همچنین حکومت دینی که از دیدگاه برخی، از اقسام دولت کمالگرا میباشد چه میزان میتواند حقوق بشر را تامین و تضمین بنماید. با توجه به مبانی اخلاقی وظیفهگرا در حقوق بشر و بیان قوانین آن در معاهدات بین المللی مانند اعلامیه جهانی حقوق بشر، میزان تطابق و تعارض دولت کمالگرا با حقوق بشر با توجه به مبانی اخلاقی آنها بررسی خواهد شد و سپس با بررسی انواع حکومتهای دینی، نسبت آن با دولت کمالگرا و تطابق یا تعارض آن با اخلاق و قوانین حقوق بشر بررسی خواهد شد. با توجه به اختلاف مبانی اخلاقی دولت کمالگرا با اخلاق حقوق بشر و تعارض آن با برخی قوانین حقوق بشر، دولت کمالگرا نمیتواند حقوق بشر را لااقل به طور کامل تامین و تضمین بنماید و حکومت دینی نیز در انواع مختلف خود از این امر جدا نخواهد بود. کلید واژگان: حقوق بشر – دولت کمالگرا – حکومت دینی – دولت حداقلی

Contrary to human rights, the perfectionist state rules by prioritizing concepts such as virtue and the categorical good instead of the right and the categorical right. This research discusses the perfectionist state and the theocracy, which is a perfectionist state from some points of view, whether they can respect and assure human rights or not. According to the ethics foundation of deontology school in human rights and the expression of its laws in international treaties such as the Universal Declaration of Human Rights, the degree of compatibility and conflict of the perfectionist state with the concepts of human rights will be examined in the light of its ethics foundations. In the following, by exploring the types of theocracies, their relationship with the perfectionist states beside their accordances and contradictions with human rights ethics and human rights laws will be studied. Considering the difference between the ethics foundations of the perfectionist state and the ethics of human rights and its conflict with some human rights laws, neither the perfectionist state nor the theocracy, even if they are compatible with Human Rights, can complitly respect and assure some of them, except for the rare cases that can overlap with Human Rights. However, it seems that even in these exceptional states, they can not assure the observance and guarantee of Human Rights in future.Key words:Human right, perfectionist state, theocracy, night-watchman state
